USE OF THE WEBSITE

Welcome to the GroomingSouq.com Website (the “Website”) an online service of Grooming House International General Trading LLC (“Grooming House”), which sells electronics, accessories and other fashion grooming items (the “Products”). By entering the Website, you hereby agree to these terms and conditions (the “Terms”). These Terms may change from time to time, therefore, please review these carefully prior to making any purchase.

Great care has been taken to ensure that the Products displayed on the Website mirror a store shopping experience, however, color clarity may vary from device to device, therefore, Grooming House cannot guarantee that the Products are identical to those viewed online.

In order to be able to make purchases through the Website, you will be requested to register. The information sought will allow Grooming House to handle your transaction efficiently and effectively and will be kept confidential by Grooming House in accordance with the Privacy Policy below. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use. Grooming House may use the information you provide to conduct suitable anti-fraud reviews, the agency involved may keep a record of that information. MAKING A PURCHASE

When you make a purchase through the Website, you are offering to buy Product(s) for the price stated, subject to these Terms.

All orders are subject to acceptance by Grooming House and Product availability.

PLACING AN ORDER

The Website contains an instructive guide through the process of placing an order.

Placing an order for any selected Product occurs by clicking on the [Confirm Order] button at the end of the on-line order process.

Once you have placed your order, you will receive an email confirming the exact details of your order and the value of your order that has been debited from your payment card.

Unless otherwise notified, Grooming House’s acceptance of your order occurs when you receive the above mentioned confirmation e-mail. Acceptance will be deemed to have occurred at the sending of this communication, regardless of technical problems you may experience, where the reasons are outside Grooming House’s control, which may result in you having not received that email in a timely manner.

Please note that while Grooming House strives to maintain availability of the Products listed on the Website, there may be occasions due to circumstances beyond Grooming House’s control, when certain Products are not available. In this case, you will receive an email informing you of such situation and you will be informed of the earliest possible delivery date of such unavailable Product(s) and given the option to await such delivery or cancel the order for such Product(s) and obtain a full refund therefor.

In the event that the ordered Product is returned to Grooming House because of an incorrect delivery address (or other details) or because the Product has not been accepted or retrieved by the customer from the courier, such costs shall be borne by the customer and Grooming House reserves the right to deduct such amount from any amount being returned by Grooming House to the customer for the returned product (or any other amount owed).

Grooming House reserves the right to reject any offer to purchase by you at any time and at our sole discretion, including if:

· an item you have ordered is out of stock;

· we are unable to obtain authorization for your payment; and/or

· we identify a Product or pricing error.

Grooming House offers our customers the Delivery Duty Unpaid (DDU) system, which means that you will only be charged for the items purchased and shipping cost. Import duty and tax cost will be invoiced to you directly by Grooming House’s couriers or an import broker appointed by you. Grooming House recommends that you contact your local customs authority to specify a cost price prior to purchase completion.

Payment will be debited from the payment card provided upon acceptance of your order by Grooming House.

You hereby confirm that the payment card used for the transaction is yours or that you have been specifically authorized by the owner of the payment card to use it for this purpose. All payment card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, Grooming House will not be liable for any delay or non-delivery.

By making an offer to purchase a Product, you authorize Grooming House to perform credit checks and to transmit or to obtain information (including any updated information) about you to or from third parties, in order to (amongst others) authenticate your identity, validate your payment card, obtain an initial payment card authorization and allow individual purchase transactions.

Grooming House takes essential precautions to ensure the security of the Website. All payment card transactions on the Website are processed using a secure online payment gateway that encrypts your card details in a secure host environment. To help ensure that your shopping experience is safe, simple and reliable, the Website uses Secure Socket Layer (SSL) technology. However, Grooming House will not be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

RETURN & EXCHANGE

Products may be exchanged within 5 days of purchase. With respect to personalized Products, those may only be sent back to Grooming House for size adjustments, provided that this does not affect any of the personalized elements of the Product.

The purchaser shall pay for the cost of returning the Product and resending any replaced Product.

In order to be accepted for exchange, the Product must be in its original packaging and remain new and unused (no marks or signs of wear on the Product or tags). Please ensure when returning the parcel that the Grooming House packaging is properly protected.

Any Product that is returned for exchange otherwise than in accordance with the above shall be returned to you at your cost.

Customs duties and sales taxes are non-refundable through Grooming House. Please note that exchanges will be submitted through the same customs procedures, therefore may be applicable for duty and tax again.

PRIVACY POLICY

Grooming House respects the privacy rights of its online customers and recognizes the importance of protecting the information so collected. We will only use the information that we collect about our customers lawfully. The trade marks, logos, and service marks displayed on the Website (collectively, the “Trade Marks”) are the registered and unregistered marks of Grooming House, our affiliates, our licensors or our partners, in the U.A.E. and other countries, and are protected by U.A.E. and international trade mark laws.

You agree that, to the fullest extent permitted by applicable law that Grooming House will not be responsible or liable (whether in contract, tort or otherwise), under any circumstances, for any:

· interruption of business;

· access delays or access interruptions to the Website;

· data non-delivery, mis-delivery, corruption, destruction or other modification

· loss or damages of any sort incurred as a result of dealings with or the presence of off- Website links on the Website;

· computer viruses, system failure or malfunction which may occur in connection with your use of the Website, including during hyperlink to or from third party websites;

· any inaccuracies, omissions or misleading, false or deceptive statement in the content; or

Further, to the fullest extent permitted by law, Grooming House will not be liable for any direct, indirect, special, incidental, or consequential damages of any kind (including lost profits) related to the Website regardless of the form of action whether in contract, tort (including negligence), or otherwise, even if Grooming House have been advised of the possibility of such damages. Because some countries do not allow the exclusion or limitation of liability for consequential or incidental damages, in such countries, Grooming House’s liability is limited to the maximum extent permitted by applicable law.

If any provision of these Terms is held to be illegal, invalid or unenforceable in whole or in part, then these Terms shall continue to be valid as to the other provisions and the remainder of the affected provision. Any waiver of any of the provisions of these Terms by Grooming House shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other provisions of these Terms.

No failure to exercise and no delay on the part of Grooming House in exercising any right, remedy, power or privilege under these Terms and no course of dealing between the parties shall be construed or operate as a waiver thereof, nor shall any single or partial exercise of any right, remedy, power or privilege preclude any other or further exercise thereof or the exercise of any other right, remedy, power or privilege. The rights and remedies provided by these Terms are cumulative and are not exclusive of any rights or remedies provided by law.

Grooming House reserves the right to change these Terms at any time. Any changes are effective immediately upon posting to the Website and your continued use of the Website constitutes your agreement to all such Terms, however, any changes made to these Terms after an order has been placed on the Website, will not affect such order, unless change is required by law.

Grooming House reserve the right to refuse to supply Products to any person for any reason whatsoever, to withdraw any Products from the Website at any time and/or remove or edit any materials or content on the Website. Grooming House will not be liable to you or any third party by reason of Grooming House withdrawing of any Product from the Website, removing or editing content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

GOVERNING LAW & DISPUTES

Your use of this Website and any purchase by you of any Product from Grooming House shall be governed by the laws of the Emirate of Dubai and the applicable federal laws of the U.A.E and you hereby submit to the exclusive jurisdiction of the U.A.E. courts.
